Real Estate Signs

Regulatory measures are in place to ensure that our public spaces remain orderly and aesthetically pleasing, while also safeguarding the interests of the community and maintaining safety standards.

In accordance with Section 68 of the Local Government Act 1993 (NSW), prior approval from Council is required for the installation of any advertising structures, including real estate signs, on public land.

Fairfield City Council does not provide approval or consent for real estate signage to be installed on public land anywhere within our local government area.

Fairfield City Council does permit the temporary placement of signage related specifically to open house inspections or auctions under the following conditions.

Temporary Placement Conditions

  • Timing: Signs may be displayed prior to the commencement of an open house or auction and must be removed by close of business on the same day.
  • Proximity: Signs must be located in close proximity to the property being advertised, ensuring clear and direct relevance to the property for sale or lease.
  • Size: Signs must not exceed the size of A3 (297 x 420 mm) to maintain visual order and minimise pedestrian obstruction.
  • Public Safety: Signs must not be placed in any location that could pose a risk to public safety or cause danger to the public, including but not limited to areas that might obstruct pedestrian or vehicular traffic.
  • Clear Passage: Signs must not obstruct the use, whether wholly or partially, of any concrete footpath, carriageway, or other public thoroughfare.
  • Prohibited Areas: Signs are strictly prohibited from being placed on any median strip areas in or on a road.

Compliance Checks and Enforcement

Regular compliance checks are conducted to ensure adherence to the temporary placement conditions outlined. Signs found not complying with these requirements may be removed by Council Enforcement Officers in accordance with the Public Spaces (Unattended Property) Act.

  • Fees and charges may apply for the retrieval of any removed signs
  • On-the-spot fines may also be issued for non-compliance with these conditions.
